Settlement reached on eve of September 11 airline trial

NEW YORK (Reuters) - What could have been the only wrongful death trial stemming from the September 11, 2001, attacks ended on Monday after the two sides reached a settlement.

The 2002 lawsuit, filed by the mother of Mark Bavis who died when United Airlines Flight 175 slammed into the World Trade Center, had accused United Airlines of negligence in allowing the five hijackers to board the flight armed.

The lawsuit in Manhattan federal court had been the only one of dozens filed after the attacks not to have resulted in a settlement until now.

The Bavis family had initially seemed intent on having the lawsuit heard by a jury of ordinary New Yorkers, and the trial had been slated for November.

There were no details of the settlement in a one-paragraph court document saying the parties had agreed to dismiss the lawsuit. The case had been presided over by U.S. District Judge Alvin Hellerstein, who has overseen much of the post-September 11 litigation.

"The family has spent nine grueling years trying to get this case to trial," the family's attorney, Donald Migliori, said. But they ultimately decided the "nature of the trial would be too limited."

The lawsuit had also named Huntleigh USA Corp, the security firm contracted by the airline to run passenger screening at Logan International Airport in Boston, where the flight originated.

The Bavis family on Friday had filed over 100 court exhibits aiming to give a detailed account of what it says were multiple overlapping layers of security lapses, from the individuals manning the Logan airport checkpoints, to United's lack of compliance with federal security rules.

United has said it implemented all the mandated government requirements for security and could not be held responsible.

"The tragic events of 9/11 impacted all of us, and we are pleased to resolve this case," a spokeswoman for United said.

1 can (15 ounces) crushed tomatoes 1 cup

hot water 1 package (9 ounces) refrigerated cheese tortellini
a cardboard box (15 ounces) low fat ricotta cheese 1 egg

1 / 4 cup grated Parmesan cheese 1 package
(10 ounces) frozen chopped spinach, thawed and squeezed dry 1 cup
mozzarella cheese

salt In a large skillet, saute the onion, basil, oregano and garlic in oil for two minutes. Add the tomatoes and hot water, bring to a boil. Add tortellini, cover and cook 5 minutes, stirring occasionally. Mix the ricotta cheese, egg and Parmesan cheese. Drop spoonfuls of spinach and ricotta then the mixture over the pasta. Cover with mozzarella cheese. Cover and cook 10 minutes more or until ricotta mixture is set. Let stand 5 minutes before serving.

Hunters should remain aware of the dangers and follow simple safety rules from the U.S. Coast Guard Auxiliary:

• Leave a float plan with someone at home, describing the destination, your companions and the time you expect to return.
• Transport firearms to the boat unloaded, cased, muzzle first and with the action open.
• Always wear approved and properly fitted life jacket when in a boat.
• Carry a throwable flotation device in case someone falls overboard.
• Stow visual distress signals on board.
• Know the weather forecast for the area. High winds can be dangerous. Cancel trip if water conditions are not safe. Keep an AM radio handy for the latest updates. Better yet, buy a VHF-FM marine radio with NOAA weather channels.
• Never overload your boat. Load gear low in the boat and distribute the weight evenly.
• Always stay seated when shooting from an open boat.
• Never anchor from the stern.
• If an accident occurs, stay with the boat and use distress signals.
• Unless clothing is creating a hazard, do not remove extra clothing. It can help prevent hypothermia.
• To retain body heat, pull your knees to your chest and keep your elbows to your sides.

If you fall overboard without a lifejacket:

• Trap air in chest waders by bending your knees and raising your feet, then lying back in the water, can help you stay afloat.
• An oar under the knees and another behind the back and shoulders can be used to keep you floating.
• Trap air in hip boots by bending your knees and lying on your back, can help you remain afloat.

Japan's defense industry hit by its first cyber attack (Reuters)

TOKYO (Reuters) ? Japan's biggest defense contractor, Mitsubishi Heavy Industries Ltd, said on Monday hackers had gained access to its computers, with one newspaper saying its submarine, missile and nuclear power plant component factories had been the target.

The company said in a statement that some information could have been stolen in the first known cyber attack on Japan's defense industry.

"We've found out that some system information such as IP addresses have been leaked and that's creepy enough," said a Mitsubishi Heavy spokesman.

"We can't rule out small possibilities of further information leakage but so far crucial data about our products or technologies have been kept safe," he said, adding the company first noticed the cyberattack on August 11.

A Japanese defense white paper released last month urged vigilance against cyber attacks after a spate of high-profile online assaults this year that included Lockheed Martin and other U.S. defense contractors.

There were suggestions at the time that those attacks had originated in China.

The Yomiuri newspaper said about 80 virus-infected computers were found at the company's Tokyo headquarters as well as manufacturing and research and development sites, including Kobe Shipyard & Machinery Works, Nagasaki Shipyard & Machinery Works and Nagoya Guidance & Propulsion System Works.

Kobe Shipyard currently builds submarines and makes components to build nuclear power stations, while the Nagasaki Shipyard makes escort ships. The Nagoya plant makes guided missiles and rocket engines, the paper said citing unnamed sources.

At least eight different kinds of computer virus including Trojan horse, which steals key information from infected computer hardware, were found at Mitsubishi Heavy's main office or production sites, the Yomiuri said.

It is the country's biggest defense contractor, winning 215 deals worth 260 billion yen ($3.4 billion) from Japan's Ministry of Defense in the year to last March, or nearly a quarter of the ministry's spending that year.

Weapons included surface-to-air Patriot missiles and AIM-7 Sparrow air-to-air missiles.

Mitsubishi Heavy has also been working closely with Boeing, making wings for its 787 Dreamliner jets.

"It's probably just the first that hacking attacks in Japan have been detected. It's consistent with what we've seen already with big American defense companies," Andrew Davies, a cyber-warfare analyst with the government backed defense think-tank, the Australian Strategic Policy Institute, told Reuters.

"The Japanese make large conventional submarines that are among the world's most sophisticated ... (they) have very nicely integrated solutions with their own mechanical, electronic and control systems, so it a pretty attractive hacking proposition, to get the design of a Japanese submarine," he added.
